Terms and Conditions
Use of the Career Group Limited (Jobs.co.nz) website is governed by the following Terms and Conditions, the Privacy Policy (028 Privacy policy.doc) and all notices and disclaimers appearing on such websites from time to time ("Terms"):
By using our site you agree to be bound by the Terms.
A. Advertisers
Before an advertisement can be placed on Jobs.co.nz an advertiser account needs to be created. In registering with Jobs.co.nz to create an advertiser account, you (the "Advertiser") agree to the following terms and conditions which apply:
- Advertiser Account can be casual (payment before the advertisement is released to the site), or an account can be a credit account with terms. Commercial Credit Account).
- Commercial Credit Accounts need to be approved by Jobs.co.nz before placing adverts.
- Invoices must be paid at the times on the terms agreed.
- Jobs.co.nz has the right to charge interest on any overdue invoice at the rate of 5% per calendar month, calculated daily on each day such invoice remains overdue. Jobs.co.nz may also disable the Advertiser’s account, refuse to supply further services to the Advertiser or remove the Advertiser’s listings until such time as the overdue invoice and all applicable interest is paid.
- Advertisements posted by the Advertiser on Jobs.co.nz are current for a period of 40 days.
- Current advertising rates and other fees and charges can be accessed at Pricing. All rates are in NZ dollars and are exclusive of goods and services tax.
- The Advertiser is responsible for proof reading and checking advertisements to be placed. Jobs.co.nz may review job advertisements, prior to publication. The Advertiser acknowledges and agrees that Jobs.co.nz may reject, remove or suspend advertisements at any time should it so wish.
- As a condition of using any services supplied by Jobs.co.nz, the advertiser must comply with the Human Rights Act 1993 (NZ) and Bill of Rights 1990 (NZ) and all anti-discrimination and equal opportunity legislation applicable in the countrues in which the conduct business.
The Advertiser warrants that the advertisement submitted by the Advertiser for publication and the advertisement as published (in either case, the “Advertisement”):
- Is genuine position as described in the Advertisement and that this is the sole purpose of the Advertisement;
- Is not misleading or deceptive to potential candidates or other persons. In particular, the Advertiser warrants that the Advertisement and the Advertiser’s conduct in connection with the Advertisement is not liable to mislead persons seeking the employment as to the availability, nature, terms or conditions of, or any other matter relating to, the employment;
- Does not contain any material that could reasonably be considered to be defamatory or offensive;
- Does not contain anything illegal and complies with all legislation, regulations and bylaws, including, but not limited to, the Fair Trading Act 1986, the Commerce Act 1986 and the Privacy Act 1993.
- The Advertiser warrants that it will not use any information obtained from any candidates for the purpose other than the assessment of the person’s suitability for the role being advertised. The Advertiser will comply with current spam and privacy legislation.
The Advertiser indemnifies Jobs.co.nz, its officers, employees and agents from any claim, action, suit, loss or liability arising (whether directly or indirectly) in connection with the Advertisement or from:
- Any breach of any warranty given by the Advertiser under the Terms of Use.
- Any negligent act or omission of the advertiser;
- The listing of any advertisement by the Advertiser on the site or any related site;
- An actual or alleged breach by the Advertiser of any law, legislation, bylaws, regulations, ordinances or codes of conduct which occur as a consequence of the Advertiser’s advertisement appearing on the site.
- The Advertiser must take all reasonable care in guarding against unauthorised use of its user name and password. Jobs.co.nz is not responsible for any unauthorised access to Advertiser accounts through failure of the Advertiser to take such reasonable care.
- The Advertiser acknowledges and agrees that by submitting an application to open an account with Jobs.co.nz, the Advertiser authorises Jobs.co.nz to obtain information on credit history.
B. Candidates
Each person searching on Jobs.co.nz as a potential candidate or applying for a position as a result of an Advertisement (a “Candidate”) agrees to the following terms and conditions:
- The Candidate agrees that information contained on this site is for personal use only and may not be sold, redistributed or used for any commercial purpose.
- The Candidate acknowledges that all Advertisements and their contents appearing on Jobs.co.nz are the responsibility of the relevant Advertiser.
- It is the Candidate’s responsibility to satisfy themselves that the advertisement is genuine and that the details he or she provides the advertiser are appropriate to the role advertised.
- The Candidate must take reasonable care in protecting against unauthorised use of log-on details. Jobs.co.nz is not responsible for any unauthorised access to the Candidate’s stored information.
- The Candidate warrants that in responding to any Advertisement or making inquiries of an Advertiser he or she does so as a genuine potential candidate in his or her own personal, non-commercial capacity.
- The Candidate indemnifies Jobs.co.nz from any claim, loss or liability arising directly or indirectly from any personal details submitted to an Advertiser.
- Jobs.co.nz reserves the right to disable the Candidate’s log-on if he or she is in breach of these Terms.
- The Candidate acknowledges that Jobs.co.nz does not endorse or recommend any of the jobs. It is up to the Candidate to obtain any necessary advice before entering into any employment or contract relationship.
C. General
The following terms and conditions apply generally to Advertisers, Candidates and other users or visitors to Jobs.co.nz, referred to as “you”:

All content appearing on Jobs.co.nz is the copyright Jobs.co.nz and is protected by the Copyright Act 1994.
The Jobs.co.nz logo device is a trademark of Career Group Limited and must not be reproduced without permission.
Submission of Advertising
In providing Jobs.co.nz with advertising you acknowledge that it is online service to facilitate the placement of candidates in available positions.
Jobs.co.nz does not provide any advice, representation, endorsement, recommendation or opinion in connection with advertised positions.
To the full extent permitted by law:
- the content appearing on Jobs.co.nz and the services is provided “as is” and without warranties of any kind, whether express or implied;
Jobs.co.nz limits its liability to you in connection with its services to:
- supplying the relevant Advertisement or service again; or
- payment of the cost of having the relevant Advertisement or service supplied again;
- Jobs.co.nz will not be liable under any circumstances for any loss of profits, indirect, consequential or incidental loss, damage or injury.
- Jobs.co.nz cannot and does not guarantee or warrant to you that files available for downloading through the site or delivered via electronic mail through the site will be free of infections or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and fir maintaining a means external to the site for the reconstruction of any lost data.
Liability
Jobs.co.nz does not take responsibility for, and excludes all liability in respect of, any of the following:
- any interruption to or inability to access any Job Board;
- any inability to log-on or access your online account;
- any delay or failure in an Advertisement being posted, archived, restored from archive, or taken down or any change to the details or content of such Advertisement being made;
- any matter, circumstance or thing beyond Jobs.co.nz control.
- Online
- You warrant that in accessing or visiting the Job Boards or any user account you will not introduce any virus or other malicious harmful or destructive code.
- You are not permitted to link any website to Jobs.co.nz prior to receiving written permission.
- Any advertising appearing on the Jobs.co.nz does not imply an endorsement or recommendation of the advertiser or their products or services.
- Privacy
- Jobs.co.nz collects personal information. The collection and use of personal information including cookies is set out in our Privacy policy, which forms part of the Terms.
General
Nothing in the Terms of Use will exclude, restrict or modify any rights or remedies which you may have under any applicable legislation which under such legislation cannot be excluded, restricted or modified by agreement.
These Terms are governed by the laws of New Zealand. Jobs.co.nz may amend, revise or replace the Terms from time to time.
Competition Terms and Conditions
These apply to any and all competitions run and promoted by Career Group Limited
- Information on how to enter and prizes form part of these terms and conditions. participation in this promotion is deemed acceptance of these terms and conditions.
- Entry is only open to New Zealand residents.
- Employees (and their immediate families) of the promoter and agencies associated with this promotion are ineligible to enter. immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- The promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Incomplete, indecipherable or illegible entries will be deemed invalid.
- Only one entry permitted per person. however, if you refer four friends in your single entry you will automatically get another chance of winning the average new zealand weekly salary.
- If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the internet account is held.
- Promotion commences 6am Monday the 12th of May. Final close 11pm 30th of May. the draws will take place at Career Group limited (the parent company of Jobs.co.nz), level 1, 49 Courtenay Place on June 10th 2010. Winners will be notified by email by the dates specified in the table below. The promoter's decision is final and no correspondence will be entered into.
- You must be 18 or over to be eligible to win.
- To claim their prize, winners must contact the promoter within one month of the date of the email notifying them of their prize.
- At the promoter's discretion, a redraw draw for any unclaimed prizes may take place at a time and place determined by the promoter. Winners of any redraw will be notified by email within 30 days of any such redraw.
- Subject to the unclaimed prize draw clause (clause 13 above), if for any reason a winner does not claim their prize by the time stipulated by the promoter, then the prize will be forfeited.
- Entrants consent to the promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the promoter, the promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the internet service provider used.
- Except for any liability that cannot be excluded by law, the promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the promoter) due to any reason beyond the reasonable control of the promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of a prize.
- The promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties. entry is conditional on providing this information. the promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. entrants should direct any request to access, update, correct or delete information to the promoter. all entries become the property of the promoter. the promoter's full privacy policy is available on the promoter's website http://www.jobs.co.nz/page/privacy-policy
